Legal terms of participation for OnlineCV Italy Contest

1. General
1.1 These legal terms contain the relevant information about the OnlineCV Italy Contest and the conditions of participation. By participating in the Contest, individuals expressly agree to these legal terms.
1.2 The Organizer reserves the right to modify the conditions set forth in these legal terms, if necessary, at its sole discretion.
2. Contest organizer
2.1. The Contest Organizer is LEAD CAREER, S.L., a Spanish limited liability company, with Tax Identification Number B66969718 and registered office at Avinguda Litoral 12-14, 5th floor; 08005, Barcelona, Spain (the “Organizer”). The Organizer is the owner and operator of www.onlinecv.it (the “Website”) through which tools and tips are offered to create CVs and cover letters.
3. Territory
3.1. The territorial scope of the Contest is the Italian Republic.
4. Contest period
4.1. The Contest will begin on October 15, 2023 and end on November 30, 2023 (the “Contest Period”). Participants must submit their entries to be eligible for consideration. The announcement of the winner will be made after the Contest end date, in accordance with Clause “7. WINNER SELECTION AND ANNOUNCEMENT” below.
4.2 The Organizer reserves the right to modify the Contest Period if necessary and/or to cancel the Contest.
5. Rules and conditions of participation
5.1 This Contest is for students enrolled in any Italian university at the time of publication of these legal terms, regardless of their nationality, their major or the level of their academic studies. Therefore students from a University outside Italy are not eligible to participate.
5.2 To participate, the student:
- Shall be of legal age according to Italian laws and regulations.
- Shall complete the participation form and provide the following mandatory information:
- Proof of university, academy or educational institution enrollment from a recognised Italian entity.
- A photocopy of a valid ID card.
- The preferred Email address for communication purposes.
Remarks:
- Participants must provide true, complete and updated documentation and information about themselves, which shall be limited to that strictly necessary to manage the participation in the Contest. Otherwise, their participation in the Contest will be rejected.
- The winner will be requested to provide their bank information for Prize payment purposes.
5.3 The criterion for admission will be the order of receipt of the OBJECT OF THE CONTEST (see clause 6).
5.4 It is not allowed to participate through agents or third parties, nor the use of multiple identities.
5.5 Employees, directors, and officers of the Organizer (and other group companies) and their immediate family members are not eligible to participate in the Contest. Likewise, any other natural person who has participated directly or indirectly in the organization of this Contest or has been directly or indirectly been involved in its preparation or development (agency, suppliers, etc.) shall not be eligible either.
5.6 The Organizer reserves the right to exclude Participants from the Contest, at its discretion, for various reasons, including but not limited to:
- Engaging in unfair or illegal behavior during the Contest that may affect the integrity of the Contest and its fair and equitable outcome.
- Engaging in manipulative actions that deceive the Organizer;
- Infringement of these legal terms.
Examples of unacceptable behavior: bribery or corruption, falsification of information, and harassment or intimidation of other contest participants or judges.
The confirmation of any of these practices will result in the cancellation of participation.
6. Object of the contest
6.1 The Participants must write an article with a length between 800 and 1,200 words titled “Looking for a job with video Resume on tiktok” (the “Article”) that must meet the following requirements:
- The Article must be unpublished, i.e., it must not have been previously published on the Internet or in any other online and/or off-line media.
- The Article should adhere to the traditional structure of introduction, body, and conclusion. The font should be Arial, size 12, with a line spacing of 1.5. It should be saved in either Word or Google Docs format and the file name should include the name of the Participant for easy identification.
6.2 Only one (1) Article per participant shall be submitted.
6.3 The Article shall be sent along with the participation form, before the Contest Period elapses.
7. Winner selection and announcement
7.1 A jury composed of editorial experts, will carefully review the Articles of participants who meet the conditions of clauses 5.2 and 6 of these legal terms.
7.2 To evaluate the Article, the jury will take into account (by way of example but not limited to): the Article’s originality, in accordance with the theme, the coherence and structure, creativity, adequate use of language, research and analysis and conclusions reached.
Remarks: It is not allowed (by way of example but not limited to) the following behaviors: plagiarism; use of artificial intelligence (AI) or any other similar technology to elaborate the Article; use of inappropriate, offensive, abusive, or discriminatory language or comments in the Article that disrespect an individual’s right to honor, personal and family privacy, and self-image.
7.3 There will be one (1) winner (the “Winner”) and one (1) alternate winner for this Contest. The alternate will be contacted only in the event that the Winner cannot be reached and/or does not accept the prize.
7.4 The announcement of the Contest ‘s Winner will occur on January 30th, 2024, through email communication to the Winner and publication on the Organizer’s Website.
Remark: The Organizer is exempted from any liability in case of any error in the data provided by the winner / alternate winner, which prevents proper notification / location of the same.
7.5 The Winner must notify the Organizer the acceptance of the Prize within thirty (30) days from the date of receiving the notification email. Failure to do so will result in the Prize being given to an alternate winner.
8. Prize
8.1. The prize is a bank transfer to the winner for the total and sole amount of one thousand euros (1,000.-€) (the “Prize”) to spend at the Winner’s discretion.
Remarks: The Organizer shall not be liable in the event that the Prize is used for illegal or unlawful purposes.
8.2 The Prize may be subjected to tax regulations and it’s the Winner’s responsibility to handle any associated tax obligations.
9. Limitation of liability
9.1. By participating in the Contest, Participants agree to these terms and conditions and acknowledge that they have read and agreed to the following liability clause and all other rules and regulations of the Contest:
- Participants agree to release and hold the Organizer, its affiliates, subsidiaries, and their respective officers, directors, employees and agents (collectively the “Released Parties”) harmless from any and all liability, claims and actions for injuries, damages or losses in connection with the participation in this Contest, including but not limited to, any claims arising out of the acceptance, use or misuse of the Prize.
- Participants acknowledge that the Released Parties shall not be responsible for any incorrect or inaccurate information provided by Participants as the Organizer has no obligation to verify the accuracy or completeness of any information provided by Participants.
- The Organizer shall not be liable if the Contest cannot be conducted, if it is unable to run as planned or if the Prize cannot be enjoyed due to unforeseen circumstances beyond the Organizer’s reasonable control.
10. Intelectual property
10.1. Participants and the Winner must have all the exploitation rights of the Article and must not have assigned any rights to a third party.
10.2. Participants and the Winner will transfer the Intellectual Property rights of their Articles to the Organizer, on an exclusive basis, and for all countries of the world, for the maximum term recognized by the regulations in force, including the rights of exploitation, reproduction, distribution, public communication, transformation, in any of the existing and known modalities of exploitation to date (the “Intellectual Property Rights”). The assignment of exclusive rights to the Organizer implies that the Participants and the Winner may not exploit their Article on their own account.
10.3. The Winner acknowledges and accepts that the amount corresponding to the Prize described in these legal terms include their Intellectual Property rights.
11. Data protection
11.1. By participating in the Contest, Participants acknowledge and agree that the Organizer collects and processes their personal data for the sole purposes of administering the Contest, selecting and announcing a winner in social media and delivering the Prize to the Winner. The Organizer is the data controller of the Participant’s personal data.
11.2. The legal basis for the Organizer to process the Participant’s personal data is the consent given by the Participant by sending an Article to the Organizer and thereby accepting these legal terms. In the event of withdrawal of the Participant’s consent, this shall not affect the lawfulness of the data processing previously carried out.
11.3 The Organizer has put in place the appropriate measures to ensure the security and confidentiality of the personal data processed. The personal data processed will not be shared to third parties, except to those for the payment of the Prize and/or as required by law. Participant’s personal data will not be the object of international transfers.
11.4. Participant’s personal data will only be processed for the Contest Period and, beyond that, Participant’s personal data will be retained, and duly blocked, in the Organizer’s information systems for as long as is needed in order to address any claim regarding the management of the Contest. Once the necessary retention period has ended, Participant’s personal data will be securely deleted from the Organizer’s information systems.
11.5 Participants can exercise their rights of access, rectification, erasure, restriction of processing, data portability and right to object, by sending us a written request (together with an image of your ID number or equivalent document proving your identity) via: info@onlinecv.it. Participants have the right to lodge a complaint before the corresponding Supervisory Authority, especially if you consider that your data protection rights have not been adequately addressed.
12. Applicable law
12.1. These legal terms shall be governed by and constructed in accordance with the laws of the Kingdom of Spain.
13. Miscellaneous
13.1 This Contest is not linked to any platform or social network. Any platform or social network does not sponsor, endorse or administer this Contest in any way, nor is it associated with it. Participants and the Winner provide their data to the data controller. The platforms are only used as a complementary channel of communication for the Winner.
13.2 The nullity, total or partial, of any of the provisions of these legal terms, will not affect the validity of the other provisions.
